Terms & Conditions

1. General

These terms apply to all orders placed with Melbourne Merch Pty Ltd (ABN 31 675 535 276). By placing an order, you agree to these terms. We reserve the right to update these terms at any time.

2. Quotes & Orders

  • All quotes are valid for 14 days unless otherwise stated.
  • Prices are quoted in AUD and are exclusive of GST unless stated otherwise.
  • An order is confirmed once a purchase order, written approval, or payment is received.
  • Minimum order quantities apply to most products. These are stated on your quote.
  • We reserve the right to adjust pricing if quantities, specifications, or timelines change after quoting.

3. Artwork & Proofs

  • Artwork must be supplied in vector format (AI, EPS, PDF) or high-resolution PNG (300 DPI minimum).
  • We provide a digital proof for approval before production begins. Changes after proof approval may incur additional charges.
  • Colour accuracy is subject to the limitations of the printing method. Pantone matching is available for screen printing.
  • You are responsible for ensuring all artwork is original or that you hold the appropriate licences.
  • Melbourne Merch is not liable for errors in artwork that have been approved by the customer.

4. Payment

  • New customers: payment is required before production begins.
  • Existing account customers: Net 14 day terms apply unless otherwise agreed.
  • We accept bank transfer, credit card (Visa, Mastercard), and Stripe payments.
  • Overdue invoices may incur a late payment fee of 2% per month.

5. Production & Delivery

  • Standard production is 7-10 business days from proof approval and payment (whichever is later).
  • Rush production may be available at additional cost.
  • Delivery timeframes are estimates only and do not constitute guaranteed delivery dates.
  • Shipping costs are quoted separately and vary based on weight, destination, and urgency.
  • Risk of loss transfers to the customer upon dispatch from our facility.

6. Quantity Tolerance

Due to the nature of custom manufacturing, delivered quantities may vary by +/- 5% from the ordered quantity. Invoicing will reflect the actual quantity delivered.

7. Returns & Defects

  • Custom printed goods cannot be returned or exchanged unless they are defective.
  • Defects must be reported within 7 days of delivery with photographic evidence.
  • We will replace or credit defective items at our discretion.
  • Minor variations in colour, placement, or sizing within industry tolerances are not considered defects.
  • We do not accept returns for customer-approved artwork errors, incorrect sizing selections, or buyer's remorse.

8. Intellectual Property

You warrant that all artwork, logos, and designs provided to us do not infringe on any third-party intellectual property rights. You indemnify Melbourne Merch against any claims arising from the use of supplied artwork.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from an order is limited to the value of the order in question. We are not liable for any indirect, consequential, or special damages.

10. Governing Law

These terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
